Terms of Service

If you access the GameFlare.com website, its localized language versions, and any associated websites operated by Gametoria s.r.o. (collectively referred to as the "Site"), you agree to these terms of use ("Terms of Use"). GameFlare.com and its network of websites is a product of Gametoria s.r.o.
These Terms of Use affect your statutory rights and obligations. If you do not agree that these Terms of Use are binding for you, do not use the Site. We may change these Terms of Use at any time. If we make material updates, we will notify registered users at least 15 days in advance (e.g., via email or a prominent notification on the Site). Non-registered users are responsible for checking periodically any changes. Your continued use of the Site after changes take effect constitutes your acceptance of the revised Terms.

Ownership

The contents of this Site, including all Site applications, software, design, text, images, illustrations, music, sound, artwork, items, graphic material, databases, proprietary information and all copyrightable or otherwise legally protectable elements of the Site, including, without limitation, the selection, sequence and all trademarks, service marks and trade names are the property of GameFlare.com and/or its licensors. Site Content may not be modified, copied, distributed, framed, reproduced, republished, downloaded, displayed, posted, transmitted, or sold in any form or by any means, in whole or in part, without the GameFlare.com's prior written permission.

Governing Law and Jurisdiction

These Terms of Use and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles.
Any legal action or proceeding arising under these Terms shall be brought exclusively before the competent courts of the Czech Republic (specifically in Brno). If you are a consumer residing in the European Union, you also benefit from the mandatory consumer protection laws of your country of residence and may bring legal claims in your local courts.

Rules

You must be at least 13 years old to use the Service.
You must not use domain names or web URLs in your username without prior written consent from GameFlare.com
You must not post, transmit or otherwise make available through or in connection with the Site any materials that are or may be: (a) threatening, harassing, degrading, hateful or intimidating, or otherwise fail to respect the rights and dignity of others; (b) defamatory, libelous, fraudulent or otherwise tortious; (c) obscene, indecent, pornographic or otherwise objectionable; or (d) protected by copyright, trademark, trade secret, right of publicity or privacy or any other proprietary right, without the express prior written consent of the applicable owner; (e) any virus, worm, Trojan horse, Easter egg, time bomb, spyware or other computer code, file or program that is or is potentially harmful or invasive or intended to damage or hijack the operation of, or to monitor the use of, any hardware, software or equipment (each, a "Virus").
You must not use the Site for any commercial purpose other than the one agreed upon by GameFlare.com
You must not create accounts with the Service through unauthorized means, including but not limited to, by using an automated devices.
You must not remove any copyright, trademark or other proprietary rights notice from the Site.
You are solely responsible for your actions. You agree that GameFlare.com is not responsible or liable for the behavior of other users.
We reserve the right to remove any of your information, content, or material from the Site if it violates these Terms of Use.
We are not responsible for user content, postings, chat, and/or communications. Users are responsible for their own actions.

Content Moderation and Notice & Action (DSA Compliance)

As a hosting provider under the EU Digital Services Act (DSA), we do not actively monitor user-generated content (such as uploaded games, comments, or chat communications) for legality. However, we act promptly upon receiving valid notices of illegal content.
If you detect any content that violates these Terms or applicable law (including copyright infringements, malware, or hate speech), you may report it to us at zahraj.sk@gmail.com. Your report should include the exact URL, an explanation of the alleged illegality, and your contact information.
We reserve the right to remove content, disable access, or suspend/terminate accounts that violate our policies or legal regulations. Users affected by such moderation actions will be notified of the reasons and have the right to appeal our decision within 6 months by contacting us directly.

Products and links

The Site may make available listings, descriptions and images of goods or services or related coupons or discounts (collectively, "Products"), as well as references and links to Products.
The Site may include links to other third party websites or resources. We have no control over such websites and resources, you acknowledge and agree that we are not responsible for the availability of such external sites or resources, and do not endorse and are not responsible for any content, advertising, products or other materials on or available from such websites or resources.

In-App Purchases and Virtual Items

The Site may allow you to purchase virtual goods, in-game add-ons, or premium features ("Virtual Items"). All purchases of Virtual Items are processed securely via third-party providers and are final and non-refundable, except as required by applicable law.
Right of Withdrawal for EU Consumers: If you are a consumer residing in the European Union, you explicitly acknowledge and agree that by purchasing Virtual Items (digital content not supplied on a tangible medium) and requesting immediate performance, you lose your 14-day statutory right of withdrawal once the download, supply, or streaming of the digital content has begun.
Virtual Items have no real-world monetary value, do not constitute private property, and cannot be redeemed or exchanged for real money or physical goods. We reserve the right to manage, modify, or eliminate Virtual Items at our sole discretion.

Access cost

You must provide, at your own expense, the equipment and Internet connections that you will need to access and use the Sites. You are solely responsible for any costs you incur to access the Sites through any wireless or other communication service.

Registration and Logins

You do not need to register to access and/or use our Site and Services. To enhance your experience you can create a user profile. When creating an account you must provide an email address and a password.
We have the right to remove or change your username if we consider it as inappropriate.
If you provide information, content, or material and use the public privacy setting, every visitor to the Site will have access to such information, and we have no control over that information or what users do with it.
If you are unsatisfied with our Services or disagree with this Terms of Use, our Privacy Policy or Cookie Policy, you may stop using our Services at any time and may request that we delete your account.

Uploading games

By uploading a file, you warrant that you own the copyright or have the necessary rights for uploading it.
You must be at least 18 years old, if you want to monetize your games.
You agree that we reserve the right to reject any game without giving any reason.

Embedding Games

GameFlare.com allows other websites to iframe portions of the website only when it provides a button "embed". You are not allowed to modify source code of embed page.

Prohibited techniques:
- Run game files from own server.
- Using sandbox parameter in iframe.
- Inserting any objects into a layer above the game.
- Block any link or connection within a game.
- Publish games without our bottom bar.
GameFlare.com reserves the right to discontinue an iframed portion of the Site at any time.

License

Permission is granted to temporarily download one copy of the materials (information or software) on GameFlare.com's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
- modify or copy the materials;
- use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
- attempt to decompile or reverse engineer any software contained on GameFlare.com's website;
- remove any copyright or other proprietary notations from the materials; or
- transfer the materials to another person or "mirror" the materials on any other server.
This license shall automatically terminate if you violate any of these restrictions and may be terminated by GameFlare.com at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

To the maximum extent permitted by applicable law, the materials on GameFlare.com's website are provided on an 'as is' basis. GameFlare.com makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights.
Further, GameFlare.com does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

Limitation Of Liability

To the maximum extent permitted by applicable law, in no event shall GameFlare.com, Gametoria s.r.o., or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on GameFlare.com's website, even if GameFlare.com or an authorized representative has been notified orally or in writing of the possibility of such damage.
Nothing in these Terms of Use shall exclude or limit our liability for death or personal injury caused by our negligence, fraud, willful misconduct, or any other liability that cannot be lawfully excluded or limited under applicable Czech and European consumer protection laws.

Copyright Infringement Claims

We respect the intellectual property of others and ask that you do the same. If you believe in good faith that materials available on the Site infringe your copyright, you may send us a written notice by e-mail, requesting that we remove such material or block access to it.

Out-of-Court Dispute Resolution

If you are a consumer and a dispute arises between us that cannot be resolved directly, you have the right to initiate an out-of-court consumer dispute resolution proceeding. For Czech and Slovak consumers, the competent authority is the Czech Trade Inspection Authority (Česká obchodní inspekce - ČOI), Štěpánská 44, 110 00 Prague 1, web: www.coi.cz.
EU consumers may also submit disputes through the Online Dispute Resolution (ODR) platform provided by the European Commission at https://ec.europa.eu/consumers/odr.

Miscellaneous Terms

These Terms of Use (including the Privacy Policy and Cookie Policy) constitute the entire agreement between you and GameFlare.com regarding the use of our Services and your Account and supersedes all prior understandings.
These Terms of Use do not create a partnership, joint venture or similar relationship between the parties, and neither party will have the power to obligate the other party in any manner whatsoever.
